Premise

Each remote sale of products on e-commerce by Exerens srl , Via Vittorio Alfieri, 11 – 50121 Florence (Fi) and the Customer, as well as any operation carried out within the e-commerce itself, is governed by these general terms and conditions of sale (hereinafter ” Terms and Conditions “).

The Terms and Conditions are subject to change by Exerens srl, it being understood that, in the relationship with the Customer, the rules provided for by the Terms and Conditions published by the Customer will apply at the time the order is placed.

Please read the Terms and Conditions and pay particular attention to the provisions in relation to the right of withdrawal .

1. Definitions

The terms and phrases listed below have the meaning indicated below, it being understood that the terms defined in the singular are also understood to be defined in the plural and vice versa.

Reserved Area: e-commerce area, given in exclusive use to the Customer, through which the same can, after authentication, access specific functions made available by Exerens srl.

Customer: any person who accesses the e-commerce.

Consumer: any natural person who acts on e-commerce for purposes unrelated to any entrepreneurial, commercial, craft or professional activity carried out, with an age greater than or equal to 18 years.

E-commerce: virtual shop accessible via the URL https://exerens.com/shop/ through which it is possible to purchase the Products.

Products: items offered in e-commerce for the purpose of their sale.

 

2. Object of the Sale and information relating to the Products

The Terms and Conditions govern the online sale of Products by Exerens srl to the Customer.

The essential characteristics of the Products are presented on the e-commerce within each product sheet. The product sheets also contain any information required by law in relation to the Product itself. The Customer, before proceeding with the purchase, is required to read the product sheets and the information contained therein.

The images of the Products offered for sale reproduce as faithfully as possible their packaging. However, such images may not correspond perfectly to reality, also for technical reasons.

Exerens srl reserves the right not to accept orders that appear anomalous in relation to the identity of the customer, the quantity of products purchased or the frequency of purchases, informing the customer if possible.

The purchase of the products offered on the e-commerce can only be made in the hypothesis in which the Products must be delivered within the Italian territory.

The offer for online sale of the Products on e-commerce is addressed solely to Consumers.

If he is not a Consumer, we invite the Customer to refrain from purchasing Products through the e-commerce.

Exerens srl reserves the right not to process orders from subjects other than the Consumer or in any case to orders that do not comply with its commercial policy, at its sole discretion, giving adequate notice if possible.

 

3 . Registration and acceptance of the Terms and Conditions

 

3.1 Registration

If the Customer is already registered, he can omit the reading of the following paragraph.

In order to purchase Products present in the e-commerce, it is necessary to proceed with a prior registration procedure, through which the Customer must accept the Terms and Conditions. The registration procedure is also necessary in order to identify the Customer.

In order to register, the Customer must correctly fill in the appropriate registration form, using the tools offered from time to time, indicating their data in the various fields , and send it to Exerens srl . The Customer is required to provide complete and truthful personal information.

Following this procedure, a dedicated Reserved Area is subsequently created, granted for use by the Customer, and accessible through specific credentials, within which it is possible to proceed with the purchase of Products, view one’s purchases, manage one’s own list of you want, access some functions and change your credentials.

 

3.2 Acceptance of the Terms and Conditions

After completing the registration procedure, the Customer can proceed with the operations aimed at purchasing the desired Product.

Before proceeding with these operations, the Customer is required to read the Terms and Conditions – paying particular attention to the clauses governing the right of withdrawal (Article 8) – as well as to print a hard copy and to store one on a durable medium that allows the Customer to keep the information that is personally addressed to him, in order to be able to access it in the future for a period of time appropriate to the purposes for which they are intended, and which allows identical reproduction of the stored information. The Customer is also obliged to always keep a copy, even by carrying out backup operations.

In order to proceed with the purchase of products on the e-commerce, the Customer must click on the Add to cart” button in the card of the Product he intends to purchase, and finally fill in the order form in electronic format, sending it to Exerens srl electronically, following the instructions given in the e-commerce.

The Customer will then be asked, in the form, to indicate the address at which he intends to receive the Product, the billing address, e-mail, mobile phone, Fiscal Code and / or VAT number and the payment instrument.

Before proceeding with the transmission of the order form, the Customer is required to identify and correct any errors in entering the data entered, checking the selected Products.

If the data are not compliant, it is possible to proceed and modify them directly from the card. The Customer also has the burden of checking the final sale price before submitting the related order form, it being understood that the price applied to the product will be that indicated at the time the order is placed by the Customer.

Following acceptance of the Terms and Conditions in the manner indicated here, the sale will be considered completed and Exerens srl will take charge of the purchase order.

Occasionally there may be problems relating to the availability of certain Products. In such circumstances Exerens srl undertakes to inform the Customer and to offer them the possibility to choose between the purchase of an item of the same nature as the one not available or the cancellation of the order. If the Customer chooses to cancel the order, no charge is made. If the charge has already been made, Exerens srl proceeds to reimburse the Customer if the order has not already been shipped.

The type of Products published and their availability may vary at any time without implying any liability of Exerens srl towards the Customer.

Exerens srl may not process purchase orders that present incomplete or incorrect data or in the event of unavailability of the Products.

 

4. Product warranties and legal guarantee of conformity

Each Product sold through e-commerce is subject to the legal guarantee of conformity, provided directly by Exerens srl , in accordance with the law.

The legal guarantee must be asserted directly by the Customer within 48 hours from the discovery of the defect, by sending Exerens srl an e-mail to info@exerens.com and a registered letter with return receipt or equivalent technology (PEC), at info@pec.exerens.it, indicating the defect found. For this reason, the Customer is required to keep the proof of purchase of the Product.

Unless proven otherwise, it is assumed that the lack of conformity that occurs within 48 hours of delivery of the Product already exist on that date, unless this hypothesis is incompatible with the nature of the goods or with the nature of the lack of conformity.

After reporting the lack of conformity, the Customer can ask Exerens srl of his choice to replace the good, without charge. The replacement does not give the right, in any case, to the termination of the sale.

 

5. Prices

The prices of the Products and the relative delivery costs may be subject to updates and are to be understood as inclusive of VAT and will be expressed in Euro currency.

The prices of the Products, including all taxes and duties, are indicated in the product sheet.

Delivery costs are indicated in the order form.

Shipping costs, included in the total cost shown, are charged to the Customer in a flat rate of € 5.00 for each order (up to 10 kg) to be delivered in Italy.

The prices indicated in the product sheets are valid until the purchase procedures are completed.

In the event that the price of a Product is discounted and the discount percentage and / or the full reference price is indicated, this indication is to be considered as referring to the price normally charged within the e-commerce.

The costs directly and indirectly relating to the connection to the Internet, necessary for the purchase of Products and the use of e-commerce, are charged to the Customer.

Any taxes, duties, duties and other charges provided for by the Law are entirely the responsibility of the Customer and paid by them upon delivery of the Products.

 

6. Terms of payment

The Customer can make the payment of the due price by credit card, paypal or any other means of payment indicated.

Exerens srl reserves the right to vary or implement, at any time, the means of payment that can be used by the Customer, it being understood that those published in the e-commerce at the time the order is sent by the Customer will be considered usable.

In case of payment by credit card, the charge to the Customer of the price takes place following the verification of the credit card data and receipt of the debit authorization from the company issuing the credit card used by the Customer.

The credit card data, sent during the execution of the orders, are protected and are sent directly to the bank that manages the payments. Payment is made directly on a secure server, in order to guarantee the security of the transaction.

 

7. Shipping and delivery of the Products

Exerens srl undertakes to ship the Products within 3 working days from the conclusion of the sale.

The delivery terms envisaged here must be considered non-binding, non-essential and merely ordering. Therefore, Exerens srl cannot be held responsible in any way for non-compliance.

Exerens srl guarantees the shipment of the Products, by couriers selected from time to time according to the Product object of the order and the place of destination, to the address indicated by the Customer at the time of registration or to a different address indicated by the Customer at the time of sending. of the order.

The Customer is required to verify, at the time of delivery of the Product, that the packaging and / or the packaging of the Products are intact, not damaged, nor wet or otherwise altered, even in the closing materials.

Any damage to the packaging or packaging of the Products must be immediately detected by the Customer by affixing a control reserve note affixed to the courier’s proof of delivery, as well as communicated to Exerens srl by filling in a form to be sent for e-mail to info@exerens.com or PEC a info@pec.exerens.it .

Otherwise, and in particular, once the courier’s document has been signed without any relief, the Customer cannot raise any objection with reference to the external characteristics of what was delivered.

 

8. Right of withdrawal

The Customer has the right to withdraw from the sale concluded with Exerens srl through the Terms and Conditions, without indicating the reasons and without any penalty, within 14 days, starting from the day in which the Customer acquires physical possession of the Product. The date indicated on the courier’s delivery document will prevail.

The Product must be returned intact, in normal wear and tear. The right of withdrawal lapses completely when it ceases when Exerens srl ascertains:

a) The lack of the original external / internal packaging;
b) The lack of integral elements of the product;
c) A use of the product such as to make it impossible to restore the conditions pre-existing to the sale.

If the Customer exercises the right of withdrawal in a way that does not comply with the methods and terms referred to in this article, he will not be entitled to a refund.

The right of withdrawal is also excluded, pursuant to art. 47, paragraph I, lett. b), Consumer Code, with reference to orders and / or contracts concerning, in whole or in part, medicines (OTC and SOP) and medical devices.

In order to comply with the withdrawal deadline, it is sufficient for the Customer to send the communication concerning the exercise of the right of withdrawal before the withdrawal period has expired. This communication can also be sent by e-mail to info@exerens.com , which must in any case be confirmed by registered letter with return receipt or PEC to info@pec.exerens.it within the following 48 hours.

In case of exercise by the Customer of the right of withdrawal, he is obliged to return the Products to Exerens srl without undue delay and in any case within the maximum term of 14 working days, starting from the date of the notice of withdrawal. The deadline is thus respected if the Customer sends back the Products before the expiry of the 14-day period starting from the sending of the notice of withdrawal.

Exerens srl may, at any time, request a copy of the document certifying the shipment of the product by the customer.

If the Customer withdraws from the agreement, all payments that he has made in favor of will be reimbursed Exerens srl , including delivery costs (with the exception of additional costs deriving from the possible choice of a type of delivery other than the least expensive type of standard delivery offered by Exerens srl ), without undue delay and in any case no later than 14 days from the day on which Exerens srl has been informed of the decision to withdraw. These refunds will be made using the same payment method used for the initial transaction, unless the Customer has expressly communicated otherwise to Exerens srl . In any case, the Customer will not have to incur any costs as a consequence of this reimbursement.

The reimbursement may be suspended by Exerens srl until receipt of the Products or until the Customer demonstrates that he has correctly returned the Products.

The costs associated with the return of the Products are entirely borne by the Customer.

This right can only be exercised by consumers, so those who make purchases for purposes related to their business activity or with the inclusion in the order of the VAT number cannot exercise the right of withdrawal.

 

9. Information relating to the Products

With regard to the Products sold within the e-commerce, all the contents relating to them (texts, images, photos, drawings, attachments, technical data sheets and so on) must not be understood as advertising material, but of an informative nature, aimed exclusively to bring the characteristics of the Products to the attention of the Customers.

 

10. Applicable law

The sale concluded in accordance with the Terms and Conditions is governed by Italian law, without prejudice to any other mandatory rule prevailing in the Customer’s country of residence.

 

11. Jurisdiction

In the event of a dispute relating to the validity, interpretation and / or application of the Terms and Conditions, the Court of the place of domicile or residence of the Customer is competent to decide on the merits, if the latter is resident in the territory of the European Union. If the Customer is not resident in the territory of the European Union, the Court of Florence is exclusively competent to decide on the merits.

 

12. Nullity and ineffectiveness of clauses

The invalidity and / or nullity and / or ineffectiveness of one or more provisions of the Terms and Conditions will not result in the invalidity and / or nullity and / or ineffectiveness of the Terms and Conditions.
